Terms of Service

Draft — not yet legally reviewed. These terms describe how Roma AI operates today, written for transparency and internal use. They have not been reviewed by a lawyer and should not be treated as a final, binding legal document until qualified legal counsel has reviewed and approved them.

1. Acceptance of terms

By creating an account or using Roma AI's website, desktop plugin, or related services (the "Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service.

2. The Service

Roma AI provides AI-powered image and video generation (via third-party model providers), a Workflow canvas for chaining generations together, an optional GPT-based prompt-enhancement feature, and an affiliate referral program. Available models, features, and pricing may change over time.

3. Accounts

You need an account to use the Service. You're responsible for keeping your login credentials secure and for all activity under your account. You must provide a valid email address and be old enough to legally enter into these terms in your jurisdiction.

4. Acceptable use

You agree not to use the Service to generate, upload, or distribute content that:

  • Is illegal, or infringes someone else's intellectual property or other rights;
  • Depicts real people in a sexual, defamatory, or otherwise harmful way without consent;
  • Constitutes harassment, hate speech, or incitement to violence;
  • Attempts to circumvent usage limits, security controls, or a model provider's own content policies.

We reserve the right to suspend or terminate accounts that violate this section, and to remove content that violates it.

5. Credits and billing

How credits work: generation features are metered in credits. The credit cost of a generation depends on the model and the settings you choose (e.g. duration, resolution, audio) and is shown before you generate.

Getting credits: the one-time Plugin purchase grants a credit balance that does not expire. Pro and Studio are recurring subscriptions that grant a fresh batch of credits each billing cycle (currently 30 days); that batch is valid for that cycle, so subscription credits don't carry over indefinitely once their cycle ends. Credits granted by us directly (support/promotional grants) or as a refund do not expire.

Refunds — credits: if a generation fails due to a system or provider error (e.g. the model provider rejects the request or errors out) or a video job stalls without a provider response, the credits you were charged are refunded automatically to your balance. We do not refund credits for a generation that completed successfully, regardless of your subjective satisfaction with the result — AI generation output can't be guaranteed to match your expectations, and a completed generation is not treated as a service failure.

Refunds — payments: purchases and subscriptions are processed by Lemon Squeezy. Requests for a monetary refund (as opposed to a credit refund for a failed generation) are handled case by case — contact us at the email below.

Cancellation: you can cancel a Pro/Studio subscription at any time from your account; you keep access through the end of the current billing cycle, and no further cycles are charged.

6. Intellectual property in generated content

As between you and us, you own the images and videos you generate through the Service, subject to (a) the rights of any third party depicted or referenced in your prompt or reference material, and (b) the underlying model providers' own terms, since generation is performed by third-party AI models we integrate with rather than models we own outright. You're responsible for making sure your use of generated content complies with applicable law and any rights of others.

We don't claim ownership of content you generate. We may use anonymized, aggregate usage data to operate, maintain, and improve the Service.

7. Third-party services

The Service relies on specialized technology partners for AI generation and prompt enhancement, account sign-in, and payment processing. Their availability, performance, and their own terms/policies are outside our control, and an outage or change on their end can affect the Service.

8. Termination

You can delete your account at any time from your account settings; this permanently removes your data as described in our Privacy Policy. We may suspend or terminate an account that violates these terms, engages in fraud or abuse, or poses a security risk to the Service or other users. Where reasonably possible, we'll try to give notice first.

9. Disclaimer of warranties

The Service, including all AI-generated output, is provided "as is" and "as available," without warranties of any kind, express or implied. We don't warrant that generated content will be accurate, appropriate, uninterrupted, or error-free, or that the Service will always be available.

10. Limitation of liability

To the maximum extent permitted by law, Roma AI and its team won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

11. Changes to these terms

We may update these terms as the Service evolves. Material changes will be reflected by updating the "Last updated" date above; continued use of the Service after a change means you accept the updated terms.
